IN NO EVENT SHALL BLOOMWISE OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. IN NO EVENT SHALL BLOOMWISE’S LIABILITY FOR ANY DAMAGES EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100 USD).

Indemnification

You agree to indemnify and hold Bloomwise and its affiliates, officers, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of a third-party.

Termination

If you wish to terminate your account with Bloomwise, you may do so at any time. We reserve the right to terminate your account without prior notice or liability for any reason, including without limitation if you breach these Terms and Conditions.

Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of Croatia, without regard to its conflict of law provisions.

Changes to These Terms and Conditions

Bloomwise reserves the right to modify or replace the Terms and Conditions at any time, in its sole discretion. If we make material changes to these Terms and Conditions, we will notify you by email or by posting a notice on the Service prior to the effective date of the changes. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the new Terms and Conditions.
